Orange Beach, AL was formed in 1984 and is located primarily south of the Intracoastal Waterway extending to the Gulf of Mexico on the south, Gulf Shores, AL on the west and Perdido Key, FL on the east. A relatively small portion of the city of Orange Beach extends north of the Intracoastal Waterway where Higher Ground is located.
Foley Beach Express 29.5 + - acres is located 1/8 mile north of the toll booth for the bridge crossing the Intracoastal on the west side of the Beach Express. The property has ¼ mile of frontage on the Beach Express and is bordered on the west by Roscoe Road, a 2 lane paved road. Vehicular access is via a deeded right-in right-out entry onto the Beach Express as well as full access along Roscoe Road. The location is near the Wharf, a large mixed use development by AIG Baker and is adjacent to Bama Bayou, a mixed use development under construction by Raley Builders and the Mitchell Company.
Foley Beach Express 29.5 +/- acres was annexed into and zoned in the city of Orange Beach in late 2005 when the city was more open to high density zoning categories. The property is zoned as GB (General Business) zoning which allows for numerous uses including retail, office, restaurant, hotel and up to 42 residential units/acre.
Since the annexation of the property in 2005, the city of Orange Beach and Gulf Shores have reached an agreement. Now the properties adjacent to the west side of the Beach Express can only be annexed into the city of Gulf Shores and properties on the east side can only be annexed into the city of Orange Beach. Thus, Foley Beach Express 29.5 + - acres, being located on the west side, is now and for the future the most northerly property in the city of Orange Beach on the west side of the Beach Express, or the first property in the city one will see when traveling toward the beach on the right side of the road. The city of Gulf Shores has indicated a reluctance to grant high density zonings in the area of the city near Foley Beach Express 29.5 + - acres. Thus, the location and zoning of the property is a significant advantage.
The city of Orange Beach has sewer and water lines with adequate capacity to serve the property located along Roscoe Road on the property's western boundary. Foley Beach Express 29.5 + - acres contains more than 25 acres of buildable uplands.
The highest and best use for the property appears to be mixed use with hotel, restaurants and retail pads on the front (Beach Express) and high density residential on the back (Roscoe Road) portion. Potentially high density residential uses on the entire property could be an advantageous use. Under the current zoning category up to 1220 residential units are allowed.
